Article 1: General provisions
The e-commerce website of Rotterdam Marathon BV sports, a private limited company with registered office at Oppert 21A, 3011 HR Rotterdam, (hereinafter 'Rotterdam Marathon BV') offers its customers the opportunity to purchase products from its webshop online. These General Terms and Conditions ('Terms') apply to every order placed by a visitor to this e-commerce website (“Customer”). By placing an order through the webshop of Rotterdam Marathon BV, the Customer agrees to the applicability of these Terms, to the exclusion of all other conditions. Additional conditions of the Customer are excluded, unless they have been accepted in advance, in writing and explicitly by Rotterdam Marathon BV.

Article 2: Price
All prices mentioned are expressed in EURO, always including VAT and all other taxes or levies imposed by the Customer. If delivery, reservation or administrative costs are charged, this will be stated separately. The price statement only applies to the items as described in words. The accompanying photos are intended for decoration and may contain elements that are not included in the price.

Article 3: Offer
Despite the fact that the online catalog and e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Rotterdam Marathon BV. Rotterdam Marathon BV is only bound by an obligation of means regarding the accuracy and completeness of the information provided. Rotterdam Marathon BV is in no way liable in case of manifest material errors, typographical or printing errors.

If the Customer has specific questions about, for example, sizes, color, availability, delivery time, or delivery method, we ask the Customer to contact our customer service in advance. The offer is always valid while stocks last and can be adjusted or withdrawn by Rotterdam Marathon BV at any time. Rotterdam Marathon BV cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is subject to conditions, this will be expressly stated in the offer.

Article 4: Online purchases
The Customer can fill his shopping cart with the desired purchases by selecting the items himself. By selecting the shopping cart, he always gets a complete overview of:
- Items included in the order
- Individual price of the items concerned
- Total price including VAT of the entire purchase
- Shipping costs charged for the delivery of the order

Discounts are only granted if the Customer enters the correct voucher code in the designated field when making his purchase. Confirmation of the purchase without registration of the discount code cannot lead to the refund of a certain discount amount after ordering.

The Customer is responsible for registering the correct delivery address to prevent incorrect shipping. The Customer must pay the full purchase amount via online payment after choosing between the available payment methods. Rotterdam Marathon BV is entitled to refuse an order due to a serious shortcoming of the Customer regarding orders in which the Customer is involved.

Article 5: Delivery and execution of the agreement
Items ordered through this webshop are delivered in the Netherlands, Belgium, France, or Luxembourg. For deliveries elsewhere, contact Rotterdam Marathon BV in advance. (via shop_marathonrotterdam_nl@golazo.com) Unless otherwise agreed or expressly stated otherwise, the goods are delivered to the Customer's place of residence within 30 days after receipt of the order. Any visible damage and/or qualitative deficiency of an item or any other deficiency in the delivery must be reported to Rotterdam Marathon BV by the Customer without delay. (via shop_marathonrotterdam_nl@golazo.com) The risk of loss or damage passes to the Customer from the moment he (or a third party designated by him, who is not the carrier) has physically received the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier of the Customer has been instructed to transport the goods and this choice has not been offered by Rotterdam Marathon BV.

Article 6: Retention of title
The delivered items remain the exclusive property of Rotterdam Marathon BV until full payment by the Customer. The Customer undertakes, if necessary, to point out the retention of title of Rotterdam Marathon BV to third parties, e.g. to anyone who would seize the not yet fully paid items.

Article 7: Right of withdrawal
The provisions of this article apply only to Customers who, in their capacity as consumers, purchase items online from Rotterdam Marathon BV. However, the right of withdrawal may be excluded for certain items and services. The Customer has the right to revoke the agreement within a period of 14 calendar days without giving reasons.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, physically takes possession of the goods.
To exercise the right of withdrawal, the Customer must notify Rotterdam Marathon BV, shop_marathonrotterdam_nl@golazo.com by means of an unequivocal statement (e.g. by post or e-mail) of his decision to withdraw from the agreement. The Customer can use the attached model withdrawal form for this purpose, but is not obliged to do so.

In order to comply with the withdrawal period, the Customer must send his notice regarding exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to The Working Group (on behalf of Rotterdam Marathon BV), Generaal de Wittelaan 15, 2800 Mechelen, Belgium, immediately, but in any case no later than 14 calendar days after the day on which he has notified Rotterdam Marathon BV of his decision to withdraw from the agreement. The Customer is on time if he returns the goods before the 14-calendar day period has expired.

The direct costs of returning the goods shall be borne by the Customer. If the returned product has diminished in value in any way, Rotterdam Marathon BV reserves the right to hold the Customer liable and claim compensation for any decrease in value of the goods resulting from the use of the goods by the Customer beyond what is necessary to determine the nature, characteristics, and functioning of the goods. Only items in the original packaging, together with all accessories and invoice or proof of purchase, can be returned. If the Customer withdraws from the agreement, Golazo sports will refund all payments received from the Customer up to that point, including standard delivery costs, to the Customer within a maximum of 14 calendar days after Rotterdam Marathon BV has been informed of the Customer's decision to withdraw from the agreement.

In the case of sales contracts, Rotterdam Marathon BV may wait with the refund until he has received all goods back, or until the Customer has demonstrated that he has returned the goods, whichever occurs first. Any additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery offered by Rotterdam Marathon BV will not be refunded. Rotterdam Marathon BV will make the refund using the same means of payment as the Customer used for the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged for such refund.

Article 8: Warranty
When the delivered items do not conform to the placed order, the legal warranty period applies. The legal warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.

To invoke the warranty, the Customer must be able to submit a proof of purchase. Customers are advised to keep the original packaging of the goods.
When a defect is detected, the Customer must inform Rotterdam Marathon BVas soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months after its discovery by the Customer. Afterwards, any right to repair or replacement lapses.

The (commercial and/or legal) warranty never applies to defects arising as a result of accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, adjustments or changes to the item, rough use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, unless proven otherwise by the Customer.

Article 10: Privacy
The personal data communicated by you will only be used for the following purposes: our customer management, processing of orders, sending newsletters, keeping you informed of our activities, advertising and/or marketing purposes.

You have a legal right to access your data, the right to correct or have your data corrected, the right to delete your data, the right to object to the processing of your data, the right to limit the processing of your data, and the right to data portability. Upon proof of identity (copy of identity card), you can request, free of charge, via a written, dated, and signed request to The Working Group (on behalf of Rotterdam Marathon BV), Generaal de Wittelaan 15, 2800 Mechelen, Belgium, shop_marathonrotterdam_nl@golazo.com, to receive the written communication of your personal data. You can oppose the use of your data for direct marketing free of charge at any time. We treat your data as confidential information and will not pass it on, rent it out, or sell it to third parties. The customer is responsible for keeping his login details confidential and using his password. Your password is stored encrypted, so Rotterdam Marathon BV has no access to your password.

Rotterdam Marathon BV sports keeps online (anonymous) visitor statistics to be able to view which pages of the website are visited to what extent. Article 11: Use of cookies

Article 12: Liability
In all cases where we can be held liable, this liability, to the extent permitted by law, is limited to the amount you actually paid for an item. Nothing in these general terms and conditions intends to limit or exclude our liability in the event of intent or gross negligence.

Article 13: Invalidity - non-waiver
If a provision of these Terms is declared invalid, illegal, or void, this shall not affect the validity, legality, and enforceability of the other provisions in any way.
Failure by Rotterdam Marathon BV sports at any time to enforce any of the rights listed in these Terms, or to exercise any such right, shall never be construed as a waiver of such provision and shall never affect the validity of these rights.

Article 14: Amendment of conditions
These Terms are supplemented by other conditions explicitly referred to, and the general terms and conditions of sale of Rotterdam Marathon BV. In case of contradiction, these Terms prevail.

Article 15: Evidence
The Customer accepts that electronic communications and backups may serve as evidence.

Article 16: Complaints handling - Disputes
If our products do not meet your expectations and you wish to make a complaint, you can contact our customer service. We will do everything we can to handle your complaint within 7 working days. You can also register your complaint via the ODR platform (https://webgate.ec.europa.eu) of the European Commission. This is a platform set up by the EU for all consumers throughout Europe.

Only Belgian law applies to our general terms and conditions, regardless of the Customer's place of residence. In the event of disputes that cannot be resolved out of court, only the courts of the jurisdiction of the registered office of Rotterdam Marathon BV are competent.
